The New York State Gaming Commission has asked a state court in Manhattan to force prediction market operator Kalshi to comply with investigative subpoenas, saying it needs the records to decide whether to seek civil penalties for alleged violations of state gambling law.

The verified petition, filed in the Supreme Court of the State of New York, County of New York, names Kalshi Inc. and KalshiEX LLC as respondents. The commission is represented by Attorney General Letitia James’ office. Pages of the petition, which carries a NYSCEF received date of Oct. 22, 2026, were posted by gaming attorney Daniel Wallach.

According to Wallach, the subpoenas seek records on Kalshi’s sports-event contracts, its offerings to New Yorkers under 21, advertising that describes its products as wagers or bets, and Kalshi’s ownership and corporate structure.
