U.S. District Judge Adam B. Adelson has denied a motion by prediction market Kalshi that attempted to block the Maryland regulators from enforcing gaming laws against it.
Kalshi filed a motion arguing that its approval from the Commodity Futures Trading Commission superseded its lack of licensing from gambling regulators in Maryland.
However, Adelson ruled that the motion couldn’t pass because Kalshi had not shown the likelihood of success in all elements of its defense. Kalshi has appealed the decision to the U.S. Court of Appeals for the Fourth Circuit.
The Maryland Lottery and Gaming Control Agency and the Maryland Lottery and Gaming Control Commission have pursued legal action against Kalshi for offering sports betting without a relevant license in the state.
