Wisconsin is defending the law allowing Native American tribes to offer online sports betting, arguing the Brown County Taxpayers’ Association doesn’t have standing to sue on the issue.
The BCTA filed suit in Waukesha County, arguing Act 247 violated the state Constitution and its 1993 amendment authorizing certain forms of gambling. The suit argued the act singles out members of the tribes for a benefit not available to others based on race.
But in the state’s reply, Assistant Attorney General Colin Roth defends the law and maintains it is legal.
The affirmative defenses claim the plaintiffs “fail to state a claim upon which relief can be granted” and that they “lack standing to pursue this action.”
