ALBANY, N.Y. (AP) — A lawsuit intended to derail plans for a casino in New York’s Finger Lakes has been dismissed.
The legal challenge was filed by Finger Lakes Gaming and Racetrack. The Rochester-area racino had argued that a state casino location board failed to consider how the proposed Lago casino in Tyre would affect other nearby gambling facilities when it endorsed Lago’s application for a casino license.
In a decision released Monday, Supreme Court Justice James Ferreira determined that the state’s casino law makes no mention of protecting existing racinos.
The lawsuit isn’t the only challenge facing the $425 million Lago Resort & Casino, one of three casino proposals chosen last fall by the casino location board. Lago had to suspend construction last month when an appeals court threw out its site plan.
Lago Resort is being built 42 miles west of Syracuse by Thomas Wilmot, the owner of Wilmorite, a Rochester shopping mall and real estate development company.
