Skill vs. chance debate will decide legality of gambling machines in Pennsylvania bars, stores

While the Pennsylvania Legislature mulls whether to add so-called skilled games as allowable machine gambling in the state, a statewide court is expected to weigh in on the issue of their current legality.

Pennsylvania’s Commonwealth Court heard arguments Wednesday morning in a case involving the state’s confiscation in 2019 of three of the Pennsylvania Skill Game machines from a sports bar in Dauphin County.

County courts have held multiple times in recent years that the devices resembling slot machines do not constitute illegal gambling because of the level to which a player’s abilities can impact winning, rather than it being determined by random chance like casino slots.
