In a class-action federal lawsuit joined by more than three dozen plaintiffs, Mount Airy Casino Resort has been accused of underpaying employees.
According to the complaint filed Feb. 7 in the Middle District of Pennsylvania by former table games dealer Jennifer Mak and former dealer and dual-rate supervisor William Neidig, Mount Airy violated the Fair Labor Standards Act (FLSA), the Pennsylvania Minimum Wage Act (PMWA) and the Wage Payment and Collection Law (WPCL).
Since the lawsuit was filed, 37 more plaintiffs have joined, as of a Feb. 24 court filing.
The complaint says Mount Airy paid the plaintiffs below minimum wage but failed to meet FLSA and PMWA requirements for notifying employees about the the tip credit.
