A Mississippi appeals court on Tuesday revived a casino dealer’s workers compensation claim over a repetitive-motion shoulder injury, ruling that the state Workers’ Compensation Commission wrongly dismissed the case as untimely.
The Court of Appeals of Mississippi in Sandra Thompson v. Boyd Biloxi LLC reversed and remanded the commission’s dismissal of Ms. Thompson’s claim against Boyd Biloxi, where she worked as a casino dealer and supervisor.
Ms. Thompson filed a petition to controvert in July 2024, alleging that repetitive movements from dealing cards and spinning roulette caused injuries to her right shoulder and upper extremity. The commission found the claim barred by the two-year statute of limitations, concluding she knew by July 2021 that her work aggravated her shoulder pain.
