Flutter wins UK appeal over problem gambler’s data consent claim

Flutter Entertainment-owned Sky Betting and Gaming (SBG) has won a landmark data protection appeal, after judges found the High Court was wrong to use a problem gambler’s addiction as the basis for voiding his consent to direct marketing.

SBG has successfully appealed the previous High Court ruling, which found it had acted unlawfully by using cookies, tracking personal data and sending targeted marketing to an anonymised problem gambler known as RTM.

The Court of Appeal, in a judgment handed down last week (21 April), overturned the earlier decision on all five grounds of appeal. The case could carry significant implications for how UK gambling operators and other businesses think about consent under data protection law.
