Florida: Seminole Tribe takes DraftKings to court over unlicensed sports betting

The Seminole Tribe is suing online gambling company DraftKings, arguing that the sportsbook is infringing on the Tribe’s exclusive control of sports betting in Florida by operating without a license in the state.

The suit was filed in Broward County. The Tribe, which operates Hard Rock Bet, alleges that DraftKings is violating state law and the 2021 Seminole Compact. The plaintiff seeks an injunction blocking operation, restitution, disgorgement of profits, and legal fees and costs.

The 72-page complaint alleges that DraftKings’ Florida platform is essentially the same as it is in other states where the company is not legally barred from providing online betting, and that the company has sued to undermine the Compact so it could operate without encumbrance in Florida.
