The Supreme Court of Austria has ordered bet-at-home to return €2.8m [$3.1m] to a player due to responsible gaming concerns. The court ruled the player to be a gambling addict and legally incapacitated while participating in online gaming with the operator.
The plaintiff had gambled with the firm’s now defunct Malta subsidiary, bet-at-home Entertainment Ltd, which was the player’s sole contractual partner. However, the court found the company’s other Malta subsidiary, bet-at-home.com Internet Ltd, to be liable for the losses under tort law.
The now wound-down subsidiary had previously set aside €2.3m to settle the case.
The German-based operator said it is assessing the impact the decision will have on its recent forecast for 2024 financial year.
