The fight over a casino in Pope County will not officially be part of the November ballot if a court filing on behalf of Arkansas Secretary of State John Thurston is approved.

Arkansas Attorney General Tim Griffin filed a brief on Monday on behalf of Thurston asking that the votes for the Amendment 2 ballot initiative not be counted. That ballot measure would, in part, determine if Pope County should have its casino license revoked.

The brief argues that the procedures for signature gathering were improperly followed, meaning that the initiative should not have been placed on the ballot. Procedures in error cited in the brief included that paid signature gatherers were not correctly certified and were improperly paid, and that the petitions turned in to the secretary of state were not properly certified.
