A major daily fantasy sports operator has sued California Attorney General Rob Bonta to stop him from releasing a legal opinion that could deem all online fantasy sports platforms illegal in the state.
Underdog Fantasy filed the lawsuit in Sacramento County Superior Court Monday, days after KCRA 3 first reported the attorney general was set to release the decision by July 3.
The lawsuit specifically argues against the legality of Bonta’s anticipated action stating he would overstep his legal authority by doing so and asks the court to temporarily block the opinion from taking effect while the court decides.
“Any potential opinion is flawed because it has to rely on factual determinations the opinion process cannot and should not resolve, according to California law…” a spokesperson for Underdog said.
