Online sportsbook giant DraftKings lost its motion to dismiss a lawsuit filed in Middlesex Superior Court last December over its $1,000 signup bonus promotion, which the suit called “unfair and deceptive.”
The class action suit was filed on Dec. 8, 2023, by the Public Health Advocacy Institute (PHAI) at Northeastern University School of Law in Boston and the school’s Center for Public Health Litigation.
After the court’s rejection of DraftKings’ motion on Wednesday, the next hearing in the case is scheduled for Dec. 10. DraftKings did not immediately respond for comment.
“This decision will allow the case to proceed to the discovery phase, where we have the opportunity to depose those involved with the deceptive promotion and collect internal communications to gain insight into how it was developed and executed,” Mark Gottlieb, executive director of PHAI, said in a release.
